What Your Warranty Covers
All dental equipment purchased new is subject to the manufacturer¹s original stated warranty.
Health Care Equipment Specialty, Inc. (HCES), as to refurbished dental equipment,
warrants that the product is free from defects in material and workmanship
for a period of one year from the date of purchase as to parts supplied by
HCES and labor for a period of ninety (90) days. Refurbished dental handpieces are
warranted for a period of ninety (90) days. Cavitron and Prophy Jets are
not covered under this warranty.
What HCES Will Do
In the event of a defect, malfunction or other failure of the product not
caused by misuse or damage to the product while in the possession of the
consumer, HCES will remedy the failure or defect, without charge to the
consumer. Defective products will be repaired with new or quality recycled
products or, at the discretion of HCES, replaced with like or similar
products at no charge.
Repairs not covered by this warranty will be performed at current cost for
parts and labor plus transit cost. HCES¹s sole obligation and your
exclusive remedy under this warranty is limited to such repair or
replacement.
How You Get Service
To obtain performance of any obligation under this warranty, contact HCES to
initiate a repair or return authorization. Defective products shall be
returned by the original purchaser within the warranty period, postage
pre-paid together with proof of purchase date, to HCES, at 900 Indiana
Ave., Wichita Falls, Texas 76301. Include your name and address and a brief
description of the defect. Properly pack the equipment. Insure your
shipment for loss or damage.
What Your Warranty Does Not Cover
The warranty does not apply to any dental equipment that has been tampered with,
nor to damages incurred through improper use and care, faulty packing or
mishandling by any common carrier.
The warranty does not apply unless installation of equipment was done by a
qualified dental technician.
Dispute Settlement Procedure
Any and all claims, disputes or controversies of any nature whatsoever
arising out of, relating to or in connection with this agreement or the
validity, scope or enforceability of this provision of the entire agreement
shall be resolved, on an individual basis, without resort to any form of
class action, by final and binding arbitration. All arbitrations shall be
administered by the American Arbitration Association in accordance with the
Code of Procedure in effect at the time the claim is filed.
Limitation of Warranty
The warranty stated above is the only warranty applicable to this product.
all other warranties, express or implied (including all warranties of
merchantability or fitness for a particular purpose) are hereby disclaimed.
No verbal or written information given by hces, its agents or employees
shall create a guaranty or in any way increase the scope of this warranty.
Repair or replacement as provided in this warranty is the exclusive remedy
of the consumer. HCES shall not be liable for incidental or consequential
damages resulting from the use of this product or arising out of any breach
of any express or implied warranty on this product. Except to the extent
prohibited by law, any implied warranty of merchantability or fitness for a
particular purpose on this product is limited to the applicable warranty
period set forth above.
How State Law Relates to this Warranty
Some states do not allow the exclusion nor limitation of incidental or
consequential damages so the above limitations or exclusions may not apply
to you.
This warranty gives you specific legal rights, and you also may have other
rights that vary from state to state.
